Who if anyone, is behind Amanda’s Bail Bond?

Amanda Knox, the American that has been through a lengthy trial in Italy, has just been convicted for the second time of murder.  She has publicly stated that she has no intentions of willingly returning to Italy for sentencing but will remain in the U.S. and continue to claim her innocence.  Her prior boyfriend, who was also found guilty of the same crime, had reportedly been trying to enter the U.S through marriage and was recently detained a few miles from the Austrian border and was suspected of trying to flee the country.

Each country has its own process of keeping tabs on those actively involved in criminal court cases, some more successful than others.  In the U.S. courts some cases may require that a bail be posted so that the person accused of a crime can be out of jail until the courts have decided the case. Often the amount of the bail is too large for many to pay so they contact a bail bond company to help them secure the funds needed..  This bond will be posted as a financial guarantee to the court that the accused will appear to any and all of the court dates as required. The failure of the defendant’s appearance will cause the bonding company to have to pay the forfeiture or the full amount of the bail.

In order for the bonding company to issue the bail bond they must have a few guarantees of their own.  These guarantees can include co-signors, larger deposits, collateral and even monitoring of the accused via GPS tracking.  Each case is different so the bail bond company should be open to looking at each case on its own merits.

 In New Jersey, bail bond companies must charge no more than 10% of the total bail not counting court fees and some other costs. Be cautious of bail bond companies offering low (less than 5%) initial premiums to get someone out of jail. They often can require an excessive amount of cosigners for many bails and fees should a weekly payment be one day late. Many say it’s a way to lose five to ten friends quickly who cosigned for you. Such tactics are currently under investigation by the state.
